These Terms & Conditions (“Terms”) govern your access to and use of the website located at https://tttdallastx.com (the “Site”) and all tree-care, removal, and related services (collectively, “Services”) offered by Texas Tree Transformations LLC (“TTT,” “Company,” “we,” “us,” or “our”). By visiting the Site, requesting an estimate, scheduling work, or otherwise engaging with us, you agree to be bound by these Terms. If you do not accept every provision below, do not use the Site or our Services.
1. Eligibility & Customer Representations
1.1 Residency & Capacity – You must be at least 18 years old and legally able to enter binding contracts under Texas law.
1.2 Accurate Information – You warrant that all information you provide (contact details, site conditions, payment data, etc.) is true, complete, and current.
1.3 Site Access – You are responsible for securing and maintaining any Internet connection, devices, permits, gate codes, or property access necessary for us to perform Services.
2. Estimates, Proposals & Scheduling
2.1 Non-Binding Estimates – Online or verbal estimates are preliminary and subject to a written proposal after an on-site inspection. Scope changes (e.g., unforeseen decay, hidden utilities, weather delays) may alter pricing.
2.2 Acceptance & Deposits – Work is scheduled only after you sign our written proposal (the “Agreement”) and, if required, pay any stated deposit.
2.3 Right to Decline – We reserve the right to refuse or reschedule any job for safety, regulatory, or operational reasons, including high-risk weather events or restricted equipment access.
2.4 Permits & Right-of-Way – Unless expressly stated in the Agreement, you are responsible for obtaining city, HOA, or utility permits and notifying neighbors or municipalities of planned work zones.
3. Safety & Property Conditions
3.1 Hazard Disclosure – You must disclose known hazards (e.g., buried lines, pets, fragile landscaping, sprinkler heads). Failure to do so may result in damage for which you assume liability.
3.2 Work Zone – During operations, you agree to keep children, pets, vehicles, and bystanders at least 50 feet away from equipment and drop zones.
3.3 Weather & Acts of God – Severe wind, lightning, or other conditions beyond our control may require immediate suspension of work; rescheduling will be coordinated in good faith.
4. Payment Terms
4.1 Pricing – All prices are in U.S. dollars and exclusive of sales tax unless noted.
4.2 Due Dates – Full payment is due upon completion or as otherwise specified in the Agreement.
4.3 Late Fees – Outstanding balances accrue interest at 1.5 % per month (18 % APR) or the maximum rate permitted by Texas law, whichever is lower.
4.4 Forms of Payment – We accept cash, major credit cards, ACH, or checks payable to Texas Tree Transformations LLC. Returned checks incur a $35 fee.
4.5 Collections – You agree to pay all reasonable costs (attorneys’ fees, court costs, collection agency fees) we incur to collect overdue amounts.
5. Cancellations
5.1 Customer Cancellation – You may cancel via phone, text or email to 4 hours before the scheduled start.
5.2 Company Cancellation – If we cancel due to safety, regulatory, or equipment issues, we will arrange a rescheduled date at your option.
6. Limited Warranty; Disclaimers
6.1 Workmanship Warranty – We warrant that Services will be performed in a professional, ANSI A300-compliant manner for 30 days after completion. Your sole remedy is re-performance of defective Services.
6.2 No Guarantee of Tree Survival – Tree health depends on soil, pests, weather, and factors beyond our control; we do not guarantee any tree’s survival or future growth.
6.3 General Disclaimer – EXCEPT AS EXPRESSLY STATED, THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7. Limitation of Liability
To the fullest extent permitted by law, TTT’s total liability for any claim arising out of or relating to the Site or Services will not exceed the amount you actually paid us for the specific Service giving rise to the claim. We are not liable for indirect, incidental, special, punitive, or consequential damages (including lost profits, property loss beyond the designated work area, or personal injury to third parties) even if advised of the possibility.
8. Intellectual Property
8.1 Site Content – All text, graphics, photos, logos, and software on the Site are owned by or licensed to TTT and protected by U.S. copyright and trademark laws.
8.2 Limited License – You may view, download, or print Site materials solely for personal, non-commercial use. Any modification, redistribution, or commercial exploitation requires our prior written consent.
8.3 User Submissions – By submitting reviews, images, or other content, you grant TTT a perpetual, worldwide, royalty-free license to use, reproduce, and display such content in any media.
9. Privacy
Your submission of personal information through the Site is governed by our Privacy Policy, incorporated herein by reference. Do not transmit sensitive personal data (e.g., Social Security numbers) via unsecured channels.
10. Links to Third-Party Sites
The Site may contain links to external websites we do not control. We are not responsible for the content, accuracy, or privacy practices of third-party sites. Linking does not imply endorsement.
11. Compliance with Laws & Environmental Regulations
You agree that all use of the Site and Services will comply with applicable Dallas city ordinances, Texas Forestry Service guidelines, and state/federal environmental laws, including proper disposal of debris and adherence to protected-species regulations.
12. Indemnification
You will defend, indemnify, and hold harmless TTT, its owners, employees, and subcontractors from any third-party claims, damages, or expenses arising out of (a) your breach of these Terms, (b) your negligence or willful misconduct, or (c) hazards or conditions on your property not disclosed to us.
13. Modifications to Terms or Services
We may update these Terms or modify/ discontinue any part of the Site or Services at any time. Changes take effect when posted. Continued use after changes constitutes acceptance.
14. Governing Law & Dispute Resolution
14.1 Texas Law – These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
14.2 Venue – Any suit or proceeding shall be brought exclusively in the state or federal courts located in Dallas County, Texas.
14.3 Jury Waiver – BOTH PARTIES WAIVE ANY RIGHT TO A JURY TRIAL.
14.4 Informal Resolution – Before litigation, the parties will attempt in good faith to resolve disputes via a written notice and 30-day negotiation period.
15. Severability & Waiver
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any right or provision is not a waiver of future enforcement.
16. Assignment
We may assign or subcontract our rights and obligations without notice. You may not assign the Agreement without our prior written consent.
17. Entire Agreement
These Terms, together with any signed proposal or work order, constitute the entire agreement between you and TTT regarding the Site and Services and supersede all prior oral or written agreements.
